1. Subject Matter

These Terms of Service govern the provision of the AlpGuardIA software as a service (SaaS) by [COMPANY_NAME] ("Provider") to the business client ("Client"). AlpGuardIA acts as a dynamic pseudonymisation proxy for requests sent to external language models. Subscribing to a plan constitutes acceptance of these Terms.

2. Pricing and Subscription Plans

• Category 1 (1–5 users): CHF 55 / month
• Category 2 (6–20 users): CHF 199 / month
• Category 3 (21–50 users): CHF 499 / month
• Enterprise (50+ users): On request

WARNING: AlpGuardIA automates filtering of standard personal identifiers. Users subject to professional secrecy (Art. 321 Swiss Criminal Code — lawyers, doctors, fiduciaries) bear exclusive responsibility for ensuring no contextual identifying information remains before sending.

3. BYOK Model and External API

THE CLIENT IS SOLELY RESPONSIBLE FOR ACQUIRING, SECURING AND PAYING FOR CONSUMPTION FEES RELATED TO THEIR EXTERNAL API KEY. ALPGUARDIA DISCLAIMS ALL LIABILITY FOR FAILURES, UNAVAILABILITY, ERRORS ("HALLUCINATIONS") OR PRICING CHANGES BY THE EXTERNAL AI PROVIDER.

4. Service Levels (SLA) and Hosting

AlpGuardIA deploys on professional Swiss cloud infrastructure (Infomaniak). No specific uptime SLA is guaranteed at this time.

5. Intellectual Property

The Provider retains full intellectual property over the source code, detection algorithms and interface of AlpGuardIA.

6. Liability Limitation and Validation Window

THE PROVIDER EXCLUDES ALL LIABILITY FOR MINOR NEGLIGENCE (ART. 100 CO) FOR DATA LEAKS RESULTING FROM AN UNDETECTED VALUE (FALSE NEGATIVE) VALIDATED BY THE USER.

ANY USE BY A PROFESSIONAL SUBJECT TO PROFESSIONAL SECRECY CONSTITUTES NON-COMPLIANT USE AND EXCLUSIVE FAULT OF THE CLIENT.

7. Payment and Termination

Subscriptions are billed monthly in advance in CHF. The Client may cancel at any time from their account. Cancellation takes effect at the end of the current billing period, with no pro-rata refund.

8. Governing Law and Jurisdiction

This agreement is exclusively governed by Swiss substantive law. Exclusive jurisdiction is at the Provider's registered office.
